Aquantuo and/or its affiliates (referred to as “Aquantuo,” “we,” “our,” or “us”) own and operate this website (www.aquantuo.com) and our mobile application (the “Aquantuo app”) to provide information and services to our members. These Terms and Conditions outline the rules governing your use of our site, app, and services. By accessing or using the site, the app, or our services, you agree to these terms in full. If you do not agree to all terms, please do not use the site, app, or services.

Accepting These Terms

By using our site, app, or services, or by registering for an account, you:

  • Confirm that you are at least 18 years old or the legal age in your jurisdiction.
  • Agree to be bound by these Terms and Conditions and our Privacy Policy.
  • Accept that your use of our platform constitutes valuable consideration, including access to information and services.

If you do not accept these terms, please discontinue using our platform.

Scope of Services

Aquantuo offers various logistics and e-commerce solutions, including but not limited to:

  1. Pickup and transportation of goods from one location to another.
  2. Assistance with purchases requested by members.
  3. International and local shipping of goods purchased online.
  4. Storage and inventory management services.
  5. Third Party Logistics services.
  6. Mall.
  7. Customs Clearance.

Certain services or promotions may be subject to additional terms and conditions (“Additional Terms”),which will be provided where applicable. In case of a conflict between these Terms and any Additional Terms, the Additional Terms will take precedence.

Modifications to Services

We may, at our sole discretion, modify, suspend, or discontinue any service, feature, or pricing without notice. We will not be liable for any losses resulting from such changes. If you disagree with any modifications, your sole remedy is to stop using our services.

Account Registration and Security

To use certain services, members must create an Aquantuo account. By registering, you agree to:

  • Provide accurate, current, and complete account information.
  • Maintain the security and confidentiality of your login credentials.
  • Not share your account with others or create multiple accounts.

If you suspect unauthorized use of your account, notify us immediately at [email protected]. We may take necessary action, including suspending or terminating your account, to maintain security.

Account Verification:

  • We may require government-issued ID verification to prevent fraud.
  • Additional verification may be needed for certain transactions.

Use of the Site and App

Members may access our services for personal or commercial use, provided they comply with these Terms. You must not use our platform:

  • To violate laws, infringe rights, or engage in fraudulent activities.
  • To disrupt, overburden, or interfere with our systems.
  • To copy, modify, or distribute our content without permission.

If you no longer wish to use our services, you may request account closure by shutting your account down. Terminating your account does not exempt you from obligations related to past transactions.

Prohibited Items and Compliance with Laws

We reserve the right to reject, hold, or dispose of prohibited items at our discretion.

Right to Decline Services

Aquantuo reserves the right to decline or cancel a service request if:

  • Fraud, misrepresentation, or suspicious activity is suspected.
  • The request conflicts with our core values or operational capabilities.
  • Customs restrictions, inaccurate information, or payment issues arise.

We may request additional information to verify transactions and refuse service if concerns persist.

Pricing and Payments

Pricing Estimates

  • All price estimates are non-binding and subject to change.
  • Final pricing may include adjustments for factors like weight, size, or additional services.

Payment Methods

Payments can be made using:

  • Credit/Debit Cards
  • Mobile Money (e.g., M-Pesa)
  • Bank or Wire Transfers

By providing payment details, you authorize Aquantuo to charge the applicable fees. Unpaid balances may result in account suspension.

Aquantuo discourages cash payments.

Refunds & Chargebacks

  • Refunds are issued at our discretion and governed by our Refund Policy.
  • Unauthorized chargebacks may result in account suspension.
  • Terminated accounts are not eligible for refunds

Storage and Last-Mile Delivery

  • Storage fees apply beyond the free storage period specified in our Storage Policy.
  • If a package is unclaimed beyond the stated period, it may be discarded or auctioned at our discretion.

Delivery Attempts

  • If a delivery attempt fails, the package will be returned to the warehouse.
  • A second failed attempt will incur additional delivery fees or require pickup.

Claims for Loss or Damage

If a package is lost or damaged, members must file a claim within 48 hours of delivery at [email protected]. Claims submitted without insurance will be denied. Our Insurance Policy stipulates Aquantuo's position on insurance cover.

Delays and Force Majeure

Aquantuo is not responsible for delays caused by factors beyond our control, including but not limited to:

  • Weather conditions
  • Customs inspections
  • Carrier disruptions
  • Natural disasters
  • Regulatory actions
  • Other third-party activities

No compensation will be provided for such delays.

Terminations and Account Closure

  • Aquantuo may terminate accounts for violations of these Terms.
  • Terminated accounts cannot be reinstated.
  • Refunds for terminated accounts are not provided

Limitation of Liability

To the fullest extent permitted by law:

  • Aquantuo is not liable for indirect, incidental, or consequential damages.
  • Our total liability is capped at $100 per claim for uninsured items.

Dispute Resolution & Governing Law

  • Disputes must first go through informal resolution before legal action.
  • Delaware law governs this agreement.
  • All disputes must be resolved in Kent County, Delaware courts.

No Class Actions

Members agree to resolve disputes individually and waive any rights to participate in class action lawsuits against Aquantuo.

Final Provisions

If any provision of these Terms is found to be invalid, the remaining terms will remain in effect.
